1. Acceptance of Terms

By creating an account, accessing, or using the StatMonje platform, websites, or features (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you (whether acting individually as a content creator or representing a brand entity) and StatMonje Technologies ("StatMonje," "we," "us," or "our").

2. Description of Service

StatMonje is an online match-making marketplace platform designed to facilitate campaigns, negotiations, and partnerships between content creators ("Creators") and business entities or agencies ("Brands").

Neutral Venue Statement: StatMonje acts solely as a facilitator matching appropriate talent with campaigns. We do not employ Creators, we are not an advertising agency, and we are not a direct party to the contract or execution of collaborations negotiated between Brands and Creators through our platform.

3. Account Eligibility & Registration

To utilize our Service, you must comply with the following:

• You must be at least 18 years old or have reached the legal age of majority in your jurisdiction.
• You agree to provide true, accurate, current, and complete details during the registration and onboarding process.
• Creators: You represent that your social media metrics, handles, audience size, and engagement numbers displayed on the platform are authentic and not artificially inflated through bots, click-farms, or engagement groups.
• Brands: You represent that your company website, details, and campaign offerings are legitimate business operations.

4. Campaign Creation & Application Rules

A. Brand Guidelines

When a Brand launches a campaign on StatMonje, the Brand must:

• Provide a clear campaign brief, deliverable list, timeline, and communication channel preference.
• Honour agreed financial payments, sponsorships, or products to shortlisted and contracted Creators.
• Not request illegal, defamatory, adult, or otherwise prohibited content promotions.

B. Creator Guidelines

When a Creator applies to a campaign, the Creator must:

• Provide honest pitches and agree to execute the requested deliverables in the specified timeframe.
• Disclose any conflicts of interest or prior relationships with direct competitors of the brand.
• Ensure all content conforms to local advertising standard guidelines (e.g., consumer protection rules requiring disclosures like #ad, #sponsored, or #collaboration).

5. Intellectual Property Rights

StatMonje IP: The software, code, layout, algorithms, icons, logo, text, graphics, and trademarks of StatMonje are protected by copyright, trademark, and intellectual property laws of India and international treaties. You may not copy, modify, distribute, or reverse-engineer our platform.

Campaign Content: Unless otherwise specified in a separate agreement between the Creator and the Brand, the Creator retains initial copyright ownership over the media they produce. However, the Creator grants the Brand a non-exclusive, worldwide, royalty-free license to use, display, and share the agreed campaign assets for marketing purposes as outlined in the campaign deliverables contract.

6. Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. STATMONJE MAKES NO WARRANTIES, EXPRESS OR IMPLIED, CONCERNING THE ACCURACY, COMPLETENESS, SECURITY, OR AVAILABILITY OF THE SERVICE.

To the maximum extent permitted by applicable law, StatMonje shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or deliverables, arising from:

• Disputes between Brands and Creators regarding campaign deliverables, quality, or payments.
• Unauthorized access to or alteration of your profile data or communications.
• Any platform downtime or unexpected maintenance issues.

7. Account Termination & Suspension

We reserve the right to suspend, terminate, or restrict your access to the Service at our sole discretion, without prior notice, if we believe your conduct violates these Terms, harms other users, or represents a security risk to the platform.

You may request account deletion at any time by accessing settings or by contacting us at support@statmonje.in.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any legal actions or proceedings arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in New Delhi or Bengaluru, India.
